Law No. ( 13 ) Of 2005

Concerning Securities Services Providers and Security of Important Trading Sectors

We, Maktoum Bin Rashid Al Maktoum, Ruler of Dubai, Do hereby promulgate the following law:
Article (1)  
  This law shall be cited as the "Law No. ( ) of 2005 concerning Securities Services Providers and the Security of Important Trading Sectors."
Article (2) Definitions  
  The following words and expressions shall have the meanings assigned against each of them, unless the context otherwise requires:
Emirate: Emirate of Dubai
Police: Dubai Police
Commander: Chief Commander of Dubai Police
Security Service Provider:
The natural or corporate person who provides securities services to individuals or governmental or non governmental establishments, including provision of janitor services, money transport, installation and maintenance of alarm systems and TV monitoring, selling of different security apparatus, equipment and services or providing securities consultations relating thereto.
Concerned Department: Department of Protective Systems in Dubai Police.
Important Trading Sectors:
The important trading enterprises which are highly exposed to risks or threat due to the kind or value of commodities they are dealing with, or the services they provide, including the banks, exchange bureaus, gold and jewelry shops, hotels, shopping malls and hospitals.
Article (3)  
 
It is not allowed to practice or license the Security Service provider for any security activity or service in the Emirate, except after obtaining the written approval from the Concerned Department of the Police and completing the required procedures in accordance with the rules determined by the implementing regulation of this Law.
Article (4)  
 
The important trading sectors shall provide the security requirements related thereto as stated in the executive regulation and the requirements of the concerned department.
Article (5)  
 
All trading sectors of all kinds, and the local and foreign governmental bodies which sponsor, organize or run parties or general events for the public shall meet the security and safety conditions as stated by the executive regulation and according to the requirements of the concerned department.
Article (6)  
 
Without prejudice to any penalties stipulated by any other legislations, any one who violates the provisions of this law, whether he was original actor, direct participator or by causing, shall be punished by imprisonment for a period not exceeding six months and a fine not less one thousand Dirhams and not exceeding thirty thousand Dirhams or by either one.
Article (7)  
 
The executive regulation of this law shall specify the fees for issuing the permits, renewal fees, violation fines, and any other fees, and such payments shall be devolved to the police account.
Article (8)  
 
Trie security service provider shall commit to coordinate with the concerned department in a way guarantees that its activity does not contradict with any security measures determined by the police, and the Concerned Department for that purpose shall have the right to examine the company's premises and records and assess its work and securities services.
Article (9)  
 
The Concerned Department shall have the right to examine and investigate the securities systems of the Important Trading Sectors to ensure their safety and compliance with the requirements, and shall also have the right to delegate or assign experts from other bodies to carry out the same.
Article (10)  
  The Commander shall issue the regulations and decisions necessary for implementing of this Law.
Article (11)  
  This Law shall be published in the Official Gazette and shall come into force on the data of such publication.
